General terms and conditions

The terms of business were last updated on 20/7/2020. Your use of SteamRex ApS (hereinafter referred to as "SteamRex") and Steamrex's online platform www.steamrex.com (hereinafter referred to as "the Platform") is considered an acceptance of SteamRex's Terms of Business, including SteamRex's Privacy Policy and Cookie Policy and any other guidelines in force at any time (collectively, the "Terms").

You furthermore confirm that you have reached the age of 18. If you cannot accept SteamRex's Terms, you may not register as a user or a service partner on the Platform. SteamRex reserves the right to amend the Terms.

1. Introduction

1.1. The website is operated by SteamRex ApS, Danish Central Business Register no. 39314088, Valhøjs alle 158, 2610 Rødovre, Denmark, email: [email protected]

2. Services

2.1. SteamRex's platform facilitates a booking function with which you can book the cleaning of your car. The actual cleaning (hereinafter referred to as "Services") is outsourced to SteamRex's independent service partners. SteamRex and each service partner are not in a subordinate relationship with each other. As such, service partners operate as independent third parties.

2.2. The Platform contains and provides access to factual information that enables SteamRex to facilitate contact between users of the Platform and SteamRex's service partners.

2.3. Standard Services only include cleaning of cars with a normal level of dirt from ordinary use. If the car is more than ordinarily dirty from use, additional services can be purchased

3. About booking Services via the Platform

3.1. Booking, coordination and payment of Services may exclusively be done via the Platform. Support is available via Support or email at www.steamrex.com or [email protected] Monday to Friday from 7.30 a.m. to 5 p.m., weekends/bank holidays from 9 a.m. to 3 p.m.

4. Communication

4.1. SteamRex is entitled to communicate directly to all users of the Platform in relation to the provision of the Service via email, telephone, app notifications, social media and communication apps.

5. Right of withdrawal

5.1. By booking, you expressly agree that SteamRex's service partner may start providing the Service and that the right of withdrawal will cease once the Service has been provided. If you withdraw before the Service has been provided in full (while the Service is being provided), your service partner shall be entitled to charge full payment for the work pre-ordered when you booked.

5.2. If you wish to withdraw from your booking, you must log in to your account and cancel it before the Service is provided. Any cancellation must be made no later than 24 hours before the booked arrival time.

6. Cancellation of or changes to booked appointment

6.1. You may change your agreement by contacting us by email ([email protected]). You may cancel or change your booking up to 24 hours before the booked appointment.

6.2. If the appointment is not cancelled or changed in a timely manner, SteamRex reserves the right to charge the full price of the Service.

7. Keys

7.1. The key transfer shall be handled by you in collaboration with your service partner. SteamRex assumes no liability for lost keys or the like.

8. Payment

8.1. Unless otherwise stated, users of the Platform shall abide by the guidelines for booking and payment of Services in force at any time. The user and service partner may not deviate from the prices set by SteamRex. Any violation of this rule will result in immediate exclusion from the Platform.

8.2. Your card information is handled by QuickPay, which operates with the highest level of security in online payment solutions. As such, SteamRex does not have access to your card information and cannot be held liable for any misuse of your card information.

8.3. You can delete, renew or change your card associated with your profile under the Account menu.

8.4. When the Services have been provided, an electronic payment link will be sent via email, SMS or similar. The link will show the amount that was stated when the Service was booked, including any options added when the car was inspected, and the total price.

8.5. A receipt for the paid order can be downloaded via the payment link immediately after payment. The total price of the purchased Service will be stated in your receipt. There will be no additional fees over and above the stated total price.

8.6. SteamRex accepts card payments via e.g. Visa, Visa/Dankort, Visa Electron and Mastercard, as well as payment via MobilePay.

9. Damages and insurance

9.1. A service partner hired through the Platform is covered by insurance in the event of damage or an accident at the place of work. Note that existing damage to windows, such as a chipped window, must be mentioned when you place an order.

9.2. SteamRex does not guarantee against any potential paint-damage associated with the defoiling of cars.

10. Complaints

10.1. SteamRex guarantees that the services provided meet SteamRex's Service descriptions in offers, agreements or deliveries, cf. www.steamrex.com.

10.2. Upon receipt of the Service, the customer shall immediately verify if the Service meets the agreed specifications.

10.3. If the customer becomes aware that the Service is incomplete or flawed, they shall immediately notify SteamRex to that effect.

10.4. Complaints about Services provided shall be submitted via email to [email protected] and include a description of the complaint and a minimum of 3 digital images that illustrate the problem clearly and well.

10.5. SteamRex and SteamRex's service partners shall be entitled to attempt to remediate any mistakes or omissions.

10.6. In addition, we refer to the provisions of the Danish Purchase Act (købeloven).

11. Termination/cancellation

11.1. You may get all of your information deleted by contacting SteamRex by email, letter or phone or via the Platform. You will then receive a confirmation of your termination by email. If you write to us by email, you will receive a confirmation within two working days. The ordinary conditions for cancellation shall nevertheless apply, cf. paragraph 8.

11.2. SteamRex may terminate or suspend your right to use the Platform at any time by giving you written notice.

12. Prohibition against direct or covert marketing on the Platform

12.1. Direct or covert marketing on the Platform by users on behalf of themselves or others is not permitted. Any action in violation of this will result in immediate suspension from the Platform.

13. Cookies.

13.1. SteamRex uses cookies and other identification technologies on our Platform, mobile applications and electronic communication media for a number of purposes, including user authentication, storing user preferences and settings, analysis of website traffic and trends and generally to understand the online behaviours and interests of people who use our Platform. Here, you can read more about the types of cookies we use, why we use them and how you can make your choices.

13.2. You may choose whether you want to accept cookies or not. However, they are an important part of the functionality of our Platform, so you should be aware that if you choose to reject or remove cookies, it may affect the availability and functionality of the Platform.

13.3. By default, most web browsers are configured to accept cookies. If you wish, you can usually choose to configure your browser to remove or reject browser cookies. To do this, follow the instructions in the browser that are usually found under the Help or Settings menu. Some external parties also enable you to reject their cookies by clicking directly on the opt-out link. We have listed the cases where this is possible in the table above.

14. Governing law and venue

14.1. SteamRex's conditions are subject to Danish law. All activities between SteamRex, its users and its service partners are deemed to be carried out in Denmark.

14.2. Disputes must be settled by the Copenhagen City Court (Københavns byret).

15. Business agreements and subscriptions, etc.

These terms and conditions shall apply unless otherwise agreed between the customer and SteamRex.

Amendments

We reserve the right, in our sole discretion, to amend or replace these Terms at any time. If an amendment is material, we will aim to give at least 30 days' notice prior to the entry into force of any new Terms. What constitutes a significant amendment shall be determined at the discretion of SteamRex. If you continue to access or use our Service after the entry into force of such amendments, you agree to be bound by such new Terms. If you do not accept the new Terms, you shall terminate your use of the Service.

Data Policy/Personal Data

At SteamRex, we take good care of your data and never share them with others unless you have allowed us to do so, or we have another legal basis for the processing of your personal data. For example, this may be in order to fulfil a legal obligation or to fulfil an agreement that we have with you. We respect your personal data. We never have and never will sell your data to a third party.

Our policy is that we exclusively use your data in order to provide you with the best and most relevant customer experience so that we can make your life easier. Moreover, we do all that we can to make our use of your data more transparent to you.

This Privacy Policy describes the way in which SteamRex collects and uses the personal data that you leave behind or provide to us whenever you visit our website and use the various services and features that we offer and make available. Version 1.2.1.20 September 2019.

  1. You must register as a user of the Platform and create a private account for personal use in order to book a Service. You are not obliged to share your password or any other similar details. You are fully responsible for the activities that are undertaken via your user profile and account. SteamRex disclaims all liability in this regard. If you come to suspect that your account on the Platform has been used by an unauthorised party, you must contact SteamRex immediately. If you provide personal data about persons other than yourself, we recommend that you first obtain consent from the persons concerned before providing such data.
  2. SteamRex does not collect or process sensitive personal data. We typically collect and process the following types of data: A unique ID and technical details relating to your computer, tablet or mobile telephone, your IP address, geographic location and which pages you click on (interests). To the extent that you give your express consent and voluntarily provide such information, we also process: Name, telephone number, e-mail address, home/business address and contact details. This typically occurs in when you create an account or when making a purchase.
  3. In order to become a user of the Platform, you must enter the following details, which you give SteamRex your consent to collect and process upon creating your account: Name, telephone number, e-mail address. We collect and store these data for the purpose of being able to provide the Service to you.
  4. SteamRex collects the data that you provide directly to us; i.e., when you create or edit your account, request Services, contact our customer support team or otherwise communicate with us. These data can include: e-mail, telephone number, payment method, Services, booking requests and other data that you choose to provide to us in connection with the creation of your profile.
  5. Data on use and preferences: We collect data on how you interact on the Platform when booking Services, your express preferences and your chosen settings. In certain cases, we collect data through the use of cookies and similar technologies, which establish and maintain unique identifiers. You can read more about this in our cookies policy on the website under conditions. We may also collect data from our partners, applications, social media and similar.
  6. You give consent for the other party in transactions brokered over the platform to leave reviews. In order to ensure that such reviews are relevant and valid, SteamRex will continuously undertake sample checks on them.
  7. Log details: Whenever you use the Platform, we collect server logs which can encompass data such as IP address, access date and time, application features or pages displayed, application failures and other system activities, browser type and any third-party websites or services that you may have used in order to interact with our Platform.
  8. Use of data. We use the data we collect about you in order to deliver, maintain and improve our Platform; for example, this includes enabling payments, sending receipts, facilitating Services and other products that you request (and sending related information), developing new functions, providing customer support to you and to Steamers, developing security features, approving users and sending product updates and administrative communications, performing internal transactions such as preventing fraud and abuse of the platform, identifying software errors and operational problems and monitoring and analysing trends in activities and use. We may also use the data in order to enable communication between you and a Steamer and to send messages to you that we believe may be of interest to you, including information about products, services, advertising campaigns and news from SteamRex.
  9. Data sharing. We may share your details with Steamers and other partners who are relevant to delivery of the Service in order that they may deliver the Service you have requested. The Platform may also include integrated functions for sharing on social media and other related tools that enable you to share your actions on the Platform with other applications, websites or media, or vice versa. Your use of such features will activate the sharing of data with friends and the public, depending on your settings for sharing on social media. Two of our data processors, Google Analytics v/Google LLC. and Facebook, Inc., are established in the USA. The necessary guarantees for the transfer of data to the USA are secured through data processor certification under the EU-US Privacy Shield Framework, cf. Article 45 of the EU's General Data Protection Regulation.   10. Analyses and marketing services provided by others. We may use your data in connection with analyses and marketing services that are delivered by our partners with a view to delivering goods or services that are broadly related to our Service.
  11. You may amend your account details at any time by logging on to the Platform. Be aware that in some cases, we may retain certain details about you because we are required to by law or for use in legal business purposes to the extent that this is permitted under applicable legislation.
  12. For so long as you are a customer of ours, we will retain your personal data. We retain personal data for three years from the time of your last service purchase at steamrex.com. We do this in order to ensure that you are provided with a positive and relevant customer experience when you return to purchase new services. We also store your invoices for up to six years in accordance with the Danish Accounting Act [Bogføringslov]. Once three years have elapsed from the date of your last purchase, all of your data will be anonymised, and any personally identifiable data will be deleted. Your customer profile will also be closed.
  13. Access to and deletion of data. In accordance with the Danish Personal Data Act, you are entitled to object both to the collection and the further processing of the aforementioned data and you may, except in the case of certain statutory exceptions, request details from SteamRex (the data controller) as to what data have been collected on you. You also have the right to withdraw any consent given.
  14. YOUR SECURITY. We have adopted technical and organisational measures to prevent your data from accidentally or unlawfully being deleted, published, lost, impaired, disclosed to an unauthorised third party, misused or otherwise processed in a manner that is in breach of the law. It is only those employees of ours who have an objective need to access your personal data in order to carry out their work who are able to access them. Moreover, all employees are subject to a duty of confidentiality.
  15. In the case that we make any changes to this personal data policy, you will be informed of this when you next visit our site.
  16. VERSIONS. This is Version 1 of SteamRex ApS' Personal Data Policy, dated 30/11/2019.
  17. The legal basis for data processing is the EU's General Data Protection Regulation, Article 6(1)(f).
  18. Complaints about personal data processing. Use of personal data
SteamRex collects personal data exclusively for the purpose of developing and then sending materials to the customer. Personal data are never passed on to third parties unless you have expressly given your permission for this, and we never collect personal data except for data that you provide to us yourself when creating an account, making a purchase or participating in a survey, etc. In these cases, the personal data that we collect include your name, address, postcode, e-mail address and the details required in order to prepare your orders. Your orders at Prik & Streg will not be displayed on the website or other media without your written consent. Personal data are used to fulfil the purchase or the service that the data have been collected in connection with. Contact relating to personal data

If you would like access to the details that SteamRex has stored on you, then direct your request to [email protected]. If the data we hold on you are incorrect or should you have any other objections, you can direct your enquiries to the same place. You are entitled to be informed as to what information is stored on you and you can object to data registration in accordance with the rules set out in the Danish Personal Data Act. Protection of personal data

In accordance with the Personal Data Act, your personal data must be stored in a secure and confidential manner. We store your personal data on computers that are subject to restricted access and located in controlled facilities and our security measures are continuously reviewed in order to ensure that our user information is handled properly and with constant respect for your rights as a user. However, we cannot guarantee 100 percent security in connection with data transfers over the Internet.

This means there may be a risk of others seizing unauthorised access to data when they are sent and stored electronically. You therefore provide personal data at your own risk and responsibility.

Personal data are deleted or anonymised continuously as the purpose for which they were originally collected ceases to apply.

The rapid development of the Internet means that we may need to make changes to how we process personal data. We therefore reserve the right to amend the present guidelines for the processing of personal data. Whenever we do this, we will amend the date for "last updated" at the top of the page. We will inform you of any substantive changes in the form of a visible message on our website.

To the extent that we process personal data about you, you will be entitled under the Personal Data Act to be informed as to what personal data can be attributed to you. Should it be discovered that the information or data that can be attributed to you are incorrect or misleading, you are entitled to have such data corrected, deleted or blocked. You are entitled to object to your data being the subject of processing at any time. You are also entitled at any time to withdraw your consent. You are entitled to complain about the processing of information and data that concerns you. Complaints should be lodged with the Danish Data Inspection Authority (Datatilsynet); cf. Danish Personal Data Act, Article 58(1).

SteamRex Standard Competition Terms

These standard terms are subject to other terms and conditions referred to at the time of competition entry/participation.

  1. The competition details constitute a part of these terms and conditions.
  2. The competition is open to everyone except for employees (and their family members) of SteamRex ApS.
  3. Participants must be aged 18 or over. You may be required to provide verification of your age and identity.
  4. The use of an incorrect name or address will result in disqualification.
  5. Entries that are incomplete or illegible will be considered as invalid.
  6. All registrations must be made directly by the person participating in the competition.
  7. No responsibility will be accepted for registrations that are lost, damaged, or delayed including as a result of computer error.
  8. The prizes are as mentioned in the competition and cannot be transferred to another person or exchanged for cash or any other alternatives.
  9. SteamRex reserves the right to change the terms of the competition and to reject participants who do not compete with a good competitive spirit.
  10. Competitions can be amended or withdrawn at any time.
  11. In the event that a prize is not available, SteamRex reserves the right to offer an alternative prize of equivalent or greater value.
  12. The winner(s) agree to the use of their name, photograph and the communication of their address and agree to assist with other reasonable requests from SteamRex regarding advertising.
  13. Unless otherwise stated, the winner(s) will be selected at random among participants who have entered the competition before the closing date cited in the advertising/competition material.
  14. A reasonable effort will be made to contact the winner(s). If it is not possible to get in contact with the winner(s) or if they are not able to comply with these terms and conditions, no new winner will be selected.
  15. Announcement of the prize will be made in writing to the winner(s).

Subscription

1. In general
1.1 SteamRex ApS, Danish Central Business Register no. 39 31 40 88, Valhøjs Alle 158, 2810 Rødovre, Denmark ("SteamRex"), offers car cleaning on a subscription basis at "SteamRex 365". By signing up for "SteamRex 365", the customer accepts the following special terms and conditions in addition to our general terms and conditions for the provision of Services (https://steamrex.com/terms).

1.2 SteamRex 365 provides access to a number of annual car cleanings via SteamRex.com or the SteamRex app. The number of cleanings is defined in the individual subscription and is made available to the customer one at a time over the course of the current period. The first cleaning is made available to the customer upon creation. This means that the customer has a remaining balance when cleaning is used immediately but is not fully funded. The remaining balance is only relevant in connection with termination and adjustments up or down, cf. paragraphs 2 and 3. The next cleaning is made available immediately in a new, commenced period.

1.3 The customer can sign up their car for SteamRex 365 via the SteamRex app or www.steamrex.com. Immediately after signing up, the customer will receive an emailed confirmation with the agreement entered into. The current agreement can also be found at any time at www.SteamRex.com and in the SteamRex App.

1.4 When the customer signs up for SteamRex 365, a car cleaning subscription is taken out for cleaning the entire car with the desired number of annual cleanings, with a minimum of 4 annual cleanings. Additional cleanings can be purchased individually and for a fee. Even though the customer has subscribed to a specific type of cleaning, they may upgrade their SteamRex cleaning and add options against a supplementary fee from time to time.

2. Payment, invoicing, etc.
2.1 With SteamRex 365, the subscriber will automatically be charged for the selected car cleaning subscription, purchase of individual cleanings and/or any options via the registered payment card.

2.2 Receipts are available in the SteamRex app or at www.steamrex.com

2.3 When signing up for and subscribing to SteamRex 365, the customer accepts an automatic monthly payment. However, see paragraph 4 on the right of withdrawal.

2.3.1 SteamRex giftcards cannot be used as payment for a SteamRex subscription.

2.4 The first subscription payment is due at the time of ordering. Thereafter, the subscription is paid monthly.

2.5 The number of annual cleanings included in the subscription, and thus the monthly price, can be adjusted in the SteamRex App or at www.steamrex.com

2.5.1 When a subscription is upgraded, future payments will be adjusted to the new monthly subscription amount. Any remaining balance resulting from previous payments will be charged upon confirmation of ordering.

2.5.2 When a subscription is downgraded, future payments will be adjusted to the new monthly subscription amount. Any remaining balance resulting from previous payments will be charged upon confirmation of ordering.

3. Termination, cancellation, etc.
3.1 The minimum consumption on signing up for a subscription is 2 cleanings.

3.2 The customer may cancel their subscription against payment of any remaiih balance from the most recent cleaning and payment of the fraction of the minimum consumption that has not been consumed. The balance can be viewed in the SteamRex App or at www.steamrex.com. The amount is to be paid upon termination and will not exceed the price of one cleaning.

However, please refer to paragraph 4.1 on the right of withdrawal for consumers.

3.3 Any fully paid cleanings that have not been used, will continue to be available to the customer in the SteamRex app or at www.steamrex.com after termination.

3.4 The subscription can be terminated in the SteamRex app, at www.steamrex.com or by sending an email to [email protected].

3.5 SteamRex may terminate or suspend the customer's membership without notice if the customer gives rise to this, including in the event of non-payment, misuse or reasonable suspicion of unauthorised use.

4. Special conditions regarding consumers, including the right to withdraw and complain
4.1. Right of withdrawal.

4.1.1. Consumers, as defined by the Danish Consumer Contracts Act (forbrugeraftaleloven) in force at any time, who have subscribed to a car cleaning service, are entitled to withdraw until 14 days after receipt of written confirmation of the conclusion of the agreement, including the present conditions.

4.1.2. The right of withdrawal can only be exercised until the expiry of the 14-day deadline. Notification of withdrawal can be submitted via email to the email address [email protected].

4.1.3. It is expressly pointed out that the right of withdrawal lapses if you as a consumer use the subscription, even if this takes place within 14 days of receiving confirmation of the agreement entered into.
